TERMS AND CONDITIONS (DISTANCE CONTRACT)

1. General Provisions 1.1. The Seller – the online store www.baronsbaits.com, hereinafter referred to as the “Online Store”, and its associated rights holder SIA “BARONS BAITS LATVIA”, registration No. 40203695590, legal address: Kliņu iela 29, Rāmava, Ķekavas pag., Ķekavas novads, LV-2111, Latvia, which, within the framework of its economic activity, offers and sells goods to the Buyer in accordance with this distance contract, hereinafter referred to as the “Contract”.

1.2. The Buyer – a legally capable natural person or authorized legal entity who places an order in the Online Store and makes payment for the goods.

1.3. The Contract is considered concluded at the moment when the Buyer has placed an order and, in accordance with these terms, has made full payment for the goods and their delivery.

1.4. The Seller reserves the right to unilaterally amend and supplement the terms of the Contract. The terms applicable to the Buyer when shopping in the Online Store are those in force at the moment of placing the order.

1.5. The Seller has the right to restrict the Buyer’s use of the Online Store services or terminate the Buyer’s registration without prior notice if the Seller believes that the Buyer is violating the terms of the Contract or attempting to harm the stability and security of the Online Store.

1.6. By placing an order, the Buyer confirms that they have read, understood, and fully agree to the terms of this Contract.

2. Registration and Personal Data Protection

2.1. To use the services of the Online Store, the Buyer can register and create a personal account or place an order as a guest, providing the essential baseline data necessary for order fulfillment.

2.2. The Buyer is fully responsible for the security of their password and for any actions taken in the Online Store using their access data.

2.3. The Buyer’s personal data is processed in accordance with the legislation of the Republic of Latvia and the General Data Protection Regulation (GDPR). The Seller implements organizational and technical measures to protect data from unlawful processing.

2.4. The Buyer’s personal data is used to identify the Buyer and the recipient of the goods, process orders, prepare invoices, and ensure delivery. Data may be transferred to cooperation partners (such as payment systems and delivery services) solely for the purpose of order fulfillment.

3. Ordering and Pricing

3.1. Prices for goods in the Online Store are indicated in EUR (euros). The company is not a VAT payer, therefore VAT is not separated in the price. The goods are sold to the Buyer at the price in force at the moment of placing the order.

3.2. The Order is accepted for processing only after the Seller has received full payment for the Goods and their delivery into the Seller’s bank account.

4. Payment Terms and Delivery Costs

4.1. The Buyer pays for the goods and delivery at the moment of placing the order, using one of the integrated payment methods in the Online Store:

  • Online Payments: bank cards (MasterCard, VISA) or internet banking (Swedbank, SEB, Citadele, Luminor, Revolut, etc.) processed via EveryPay.
  • Bank Transfer (Direct Bank Transfer): After placing an order, the Buyer receives a prepayment invoice by e-mail.

4.2. Delivery costs in force at the moment of placing the order are indicated in the Online Store. The total order amount, including delivery, is displayed to the Buyer before final checkout.

5. Delivery of Goods

5.1. The Seller provides delivery of goods within the territory of Latvia using the Omniva parcel machine (pakomāts) network, courier delivery, or by ensuring order collection directly at the production facility.

5.2. The Seller will make every effort to fully fulfill the order. If the ordered goods are out of stock or insufficient in quantity (the goods are in the production process), the Seller has the right to extend the delivery time by agreeing with the Buyer via phone, or to cancel the order.

5.3. If delivery fails due to the Buyer’s fault (incorrect address, failure to collect the shipment within the timeframe specified by Omniva), the goods will not be resent without an additional charge, and the payment for the goods will be refunded, deducting the actual delivery and return costs.

5.4. Upon receipt of the goods, the Buyer is obliged to check the quality of the packaging and the conformity of the goods. If visual damage to the packaging is detected, the Buyer must make a note on the delivery document or immediately inform the Seller via e-mail: info@baronsbaits.com.

6. Right of Withdrawal and Returns

6.1. The Buyer (consumer) has the right to withdraw from the purchased goods within 14 calendar days from the moment of receipt of the goods by sending a written withdrawal request to the e-mail: info@baronsbaits.com.

6.2. CRITICAL CONDITION FOR CARP BAIT (boilies, liquids, etc.): According to Regulations No. 255 of the Cabinet of Ministers of the Republic of Latvia (Paragraphs 22.4 and 22.5), the right of withdrawal cannot be exercised for goods that deteriorate rapidly or expire quickly, as well as for sealed goods that have been unsealed after delivery and are not suitable for return due to health, hygiene, or safety reasons. Only fully unopened, undamaged goods in their original packaging are accepted for return.

6.3. The direct costs of returning the goods (transportation costs) shall be covered by the Buyer.

6.4. The Seller shall refund the amount paid for the goods (excluding delivery costs) to the Buyer within 14 days from the day the returned goods are received back at the Seller’s facility and their condition has been inspected.

6.5. The Buyer is fully responsible for maintaining the quality and safety of the goods during the period of exercising the right of withdrawal.

7. Product Quality and Warranty

7.1. The characteristics and composition of all goods sold in the Online Store are specified in the description of each product. The Seller guarantees the compliance of the goods with the manufacturer’s specifications and the standards of the Food and Veterinary Service of Latvia (PVD).

7.2. The warranty procedure specified in the legislation of the Republic of Latvia applies to the goods.

8. Final Provisions

8.1. The Seller is not responsible for delivery delays caused by the fault of the courier service or due to circumstances of force majeure.

8.2. The Seller is not responsible for any slight variations in color or shape between the product images displayed in the Online Store and the actual appearance of the goods due to the screen characteristics of the Buyer’s computer or monitor.

8.3. All disputes shall be resolved through mutual negotiations. If an agreement cannot be reached, the dispute shall be resolved in accordance with the legislation of the Republic of Latvia.
